Therefore, given the coordination effort required to follow up and monitor the EREIs, it is essential to develop an innovative solution that is capable of monitoring and evaluating the evolution of the Portuguese SNI (National Innovation System) in an integrated manner, so that it is possible to assess the extent to which the dynamics observed are occurring in a convergent manner with what is recommended by the ENEI 2030, as well as by the EREIs.
Preliminary Market Consultation
Prior to the public procurement procedure, a preliminary market consultation (PMC) will be carried out, the aim of which is to gather information on technological advances, alternatives, innovations and market prices, thus enabling the identification of possible solutions that can respond to the challenges defined by ANI. This consultation is essential for defining, in future procurement procedures, the technical and functional characteristics of the infrastructure to be developed.
In this context, and in order to prepare the possible procurement procedure for one or more projects aimed at creating a centralized infrastructure to support the governance of innovation policies, this invitation to participate in the preliminary market consultation is published. The consultation consists of listening to the market, guided by a series of dialogues with economic operators, with the aim of informing them about the technological and operational challenges that ANI has identified, as well as the specific needs that are expected to be met by the proposed solution.
The launch event for the Preliminary Market Consultation for the GenAI Innovation Data Space project took place at ANI’s premises in Porto on November 20, 2024. The CPM falls within the scope of ANI’s strategy for monitoring and evaluating ENEI 2030, set out in Article 35-A(1) of the Public Contracts Code (CCP), and is implemented through the GenAI Innovation Data Space / Centralized Innovation Data Infrastructure with Generative AI project.

1. GENERAL PRELIMINARY CONSULTATION PROCESS
1.1 What are you looking for?
The aim is to obtain proposals from the market for innovative solutions designed to meet the challenge posed by the use of technologies that exceed the performance of those currently on the market.
These solution proposals will be used to assess the market’s capabilities and level of maturity, define the functional specifications and, for those that involve innovation, whether they are feasible to achieve, as well as defining the characteristics that should be included in the procedural documents of a possible public procurement procedure.
The aim of this type of consultation is not to obtain binding final proposals, but rather proposals for solutions that will make it possible to define how the needs identified by ANI can be met.
1.2 Does the consultation have selection criteria?
The consultation has no selection criteria. There will be specific criteria in the public procurement procedure to be triggered.
1.3 What solutions are you looking for, more or less far from the market?
The degree of proximity to the existing market is irrelevant. Innovative solutions are sought, or solutions that involve adapting those already on the market, provided that they meet the needs identified and contribute to a general improvement in the public service provided.
1.4 How do bidders who are not based in Portugal participate? Would they have problems applying for the future public procurement procedure?
The call for proposals within the scope of this consultation is completely open to competition.
For the future public procurement procedure, the participating entities may not be in situations of impediment, in accordance with the provisions of article 55 of the CCP, and must comply with the requirements and conditions indicated in the procedure documents.

2.2 What stage are the PPI projects at?
In the preliminary market consultation phase, the needs to be covered through innovative solutions were identified.
2.3 How can I submit a proposal?
Proposals will be sent using the form available on the ANI website at https://ani.pt/genai-innovation-data-space/, where it will be possible to send attachments.
2.4 Is the company to be contracted available to work (technical office) on the contractor’s premises (ANI)?
The company NAME OF COMPANY (If applicable) will carry out tasks entrusted to it by ANI within the scope of the GenAI Innovation Data Space, in whole or in part, in the space made available by the contracting authority.
2.5 Is it possible to submit a proposal in collaboration with another entity?
It is possible to submit proposals individually or jointly with other entities and to submit as many proposals as indicated in the regulation.
2.6 Are consortia with Portuguese and foreign partners allowed?
Yes, all operators can take part in the Consultation individually or together with other Portuguese or foreign partners.
2.7 Will the attendance list for the Preliminary Market Consultation Presentation Day be published?

2.8 Will the information contained in the application forms in response to the Preliminary Market Consultation (and not that of the additional documents classified as confidential) always be published to all applicants?
The information provided may be published. In general, only summaries of proposals and non-confidential information are made public.
2.9 How is the confidentiality of the documentation submitted covered?
Technical or commercial information which, where appropriate, has been provided by participants and which they have designated and substantiated as confidential (by means of annexes) may not be disclosed.
It is up to the participants to identify the documentation or technical or commercial information that they consider confidential. Participants may designate any of the documents provided as annexes as confidential. This circumstance must be clearly reflected (in any way, or in the margin) in the document designated as such.
2.10 Once the application has been submitted, what are the procedures?
After the preliminary market consultation, the results will be made public, respecting the principle of confidentiality.
If deemed appropriate, the preparation and processing of the proposal(s) may begin on the basis of the ideas for solutions gathered following the consultation. In any case, these procedures will be open to all possible proposals that meet the established conditions, regardless of whether or not they have been associated with the preliminary market consultation.
2.11 Will participants be notified of new information on the progress of the preliminary consultations?
Notification will be made through the channels provided on the form, preferably by e-mail.
2.12 Will interviews with applicants to gather more information take place before or after the application deadline?
Interviews, if they take place, will be held once the deadline for receipt of proposals has passed.
2.13 Will all applicants be called for an interview?
First, the proposals received will be analyzed and the agents selected for the interview phase will be determined. It will not be compulsory to interview all of them, but if possible, a selection will be made.

2.15 What is the deadline for submitting bids?
The deadline for submitting proposals begins on the day following the publication of the call for proposals on the ANI Contractor Profile and ends on January 10th 2025.
3. QUESTIONS ABOUT THE PARTICIPATION FORM
3.1 Can a totally confidential application form be submitted, i.e. one that can be considered by ANI to build the bidding documents, but which is not published to the other bidders?
No, the application form cannot be confidential (the annexes or complementary documents can).
3.2 What is the format for submitting the attached documentation?
The presentation format will be Word or pdf.
3.3 Is a specific TRL established for the solutions provided?
A specific TRL is not established, the consultation seeks to establish the level of maturity
of the projects.
3.4 Is participation in the consultation a requirement for admission to a future procurement procedure?
No, the possible contracting procedure will be open to competition, so any entities may participate, regardless of whether or not they have been consulted as part of this preliminary market consultation, as long as they meet the conditions and requirements set out in the respective procedural documents.
3.5 Will a specific Intellectual and Industrial Property Rights (IPR) model be established?
No rigid model has been established for the regulation of DPII, and it remains open to various proposals from the participating entities. However, entities are expected to report on any limitations in terms of DPII, including pre-existing rights and those generated during the project, and to propose an appropriate management model that includes assignment, shared use and the granting of licenses to third parties.
3.6 What does it mean to share intellectual property rights with the contracting entity or to establish royalties on sales?
Intellectual property rights can be divided into three categories: pre-existing rights of the entities, pre-existing rights of the public purchaser and rights generated during the collaboration. In its proposal, the entity must detail its approach to managing these rights, taking into account the possibility of assigning them, sublicensing them and sharing the benefits derived from commercialization.
In the future procurement procedure, this intellectual property will be regulated.
3.7 In the section “Benefits provided by the proposed solution for other agents (max. 850 characters)”, what is meant by “other agents”?
This refers to other entities (in a general sense) that could benefit (directly or indirectly) from the proposal they submit. By way of example, but not limited to, these could be other public bodies, non-profit organizations or other companies. This is to highlight the benefits (direct and indirect) that the solution/project they propose could provide.
